As regards the sale of the works, it is important to underline that the artist works in Italy, a country in which the export of works of art is regulated by very strict ministerial regulations aimed at protecting the national artistic heritage.

The artist manages his Atelier located in Rome · Italy and regularly sells his works within the Italian territory through a dedicated website in Italian (specific platform for Italian buyers).

The air-conditioned storage and conservation place for works of art (vault) is located in Rome · RM · Lazio · Italy. Each booked work, regardless of the final destination, is previously extracted from the vault and transferred to the atelier where it is entrusted to the shipper: as reported in the shipping documents, the above atelier is located in: Rome – Italy.

TRANSPORT

ART ATELIER takes care of the transport of the work, including all export processes in Europe and around the world, managing all the technical and bureaucratic phases relating to this extremely complex aspect. The customs policies of various countries (particularly those outside Europe) regarding the regulation of the importation of works of art are different for each nation. This variety, severity and discordance of laws and regulations makes the process of import-export of works of art one of the most complicated market procedures in the world. The methods, type, logistics, timing and costs of delivery of the booked work therefore vary from case to case and are strictly related to the final destination of the work.

CUSTOMS

⚠️ Please note: THE COSTS RELATED TO THE CUSTOMS CLEARANCE OF THE WORK OF ART (an essential procedure for completing the delivery of the work to the buyer) ARE ALWAYS PAID BY THE BUYER. When the work of art arrives in the country of final destination, the buyer will be contacted (generally by telephone call, e-mail or telephone message) by the shipping agent and/or customs inspector in charge, who will communicate to the buyer the exact amount to be paid (customs duty) to complete customs clearance and, therefore, entry (import) of the work of art into the country of destination. Clearly, in the aforementioned communication, the methods and details for making the payment will be specified.

⚠️ IMPORTANT: the refusal by the buyer and/or the prolonged unavailability of the same for the purposes of making the payment necessary for the customs release of the work of art (in custody at customs) irreversibly invalidates the delivery operation of the the work of art in question. In this case, no responsibility for the failure to deliver the purchased work can be attributed to the artist who sells the work and with whom the purchase contract was previously stipulated.

PAYMENT

Payment for the purchase of the work of art, including technical shipping costs, always takes place in advance and by BANK TRANSFER (the details for making the relevant bank transfer will be communicated when booking the work).

TECHNICAL TRANSPORT

EUROPE (European Economic Community EEC)

If the buyer resides within the European Community (and outside of Italy), keep in mind that, following the bank transfer (relating to the costs of purchasing the work of art together with those of its technical shipping) the request for ministerial unblocking of the work for the purposes of export outside Italy will be promptly initiated: this procedure is independent of the timing of our organization and depends directly on that of the Italian Government – MiC Ministry of Cultural Heritage. In this regard, we tend to underline that, sometimes, a period of up to 30 days (rarely more than 30 days) is necessary before obtaining the export authorization. The (pending) customer will receive constant and detailed updates on the progress of the aforementioned request. In principle, keep in mind that, for the aforementioned reasons, it will be necessary, after payment, a period of approximately 30 days (day more, day less) before receiving the work at the delivery address agreed during the reservation phase, except for any delays during customs clearance.

CUSTOMS

⚠️ Also keep in mind that, although in this case the buyer resides within the EEC European Economic Community (a government organization which, theoretically, should favor the “free movement of people and goods” within the community territory), depending on the country of destination, in practice, if requested by certain EU states (such as Portugal), customs checks could occur due to the intrinsic nature of the imported good: in this case a Work of Art. The particular nature of the good in question (as a subject of extreme attention by the respective Ministries of Cultural Heritage of the various EU states), could, depending on the final destination (State receiving the work), impose certain customs duties for the purposes of import. In this case, the buyer will be informed (by communication from the freight forwarder and/or customs inspector) of the need to proceed with the payment of the customs duty, where imposed, for the purposes of customs clearance of the work. CUSTOMS CLEARANCE COSTS, IF ANY, ARE ALWAYS PAID BY THE BUYER. Generally the contact takes place by means of a telephone call, e-mail or telephone message (through which the methods and details for payment in favor of the relevant customs will be communicated).

PURCHASE CONTRACT WITH EEC CUSTOMERS

  • The asset in question in this case consists of: Work of Art (unique and unrepeatable example) | not comparable to the industrial genre of “common goods” reproduced in a serial manner | bearer of intellectual property rights (rights held by the artist, inextinguishable even after the sale – transfer of ownership of the work from the artist to the buyer) | global copyright holder – Copyright © | bearer of publication rights (special rules and limitations established in the contractual phase) | bearer of special rights relating to the re-sale of the good itself in favor of third parties (special rules and limitations established in the contractual phase) | bearer of intrinsic cultural value and, as such, subject to a type of control expressly regulated by the Ministry of Cultural Heritage and sanctioned, by law, by the Italian Government.

Based on the rules that regulate the Right of Withdrawal (governed by Legislative Decree no. 21/2014 which implemented Directive 2011/83/EU on consumer rights) and on the basis of the rules that regulate the Consumer Code (Legislative Decree 6 September 2005, n. 206) and, in particular, based on the provisions of the art. 59-paragraph 1-letter B (« Exceptions to the Right of Withdrawal ») of the aforementioned Consumer Code, relating to: « supply of goods or services whose price is linked to fluctuations in the financial market that the professional is not able to control and which may occur during the withdrawal period », the Right of Withdrawal does not find application and validity in the specific case.

EXTRA-EEC COUNTRIES

In the event that the buyer resides outside the European Economic Community, keep in mind that, following the bank transfer (relating to the costs of purchasing the work of art together with those of its technical shipping), the request for ministerial unblocking of the work for the purposes of export outside Italy will be promptly initiated: this procedure is independent of the timing of our organization and depends directly on that of the Italian Government – MiC Ministry of Cultural Heritage. Note

In the case of shipping, when booking a work you will be asked to provide a telephone number. This is essential to guarantee the correct outcome of the delivery.

IDENTIFICATION DOCUMENT

Note

During the guided booking procedure, you will also be asked to send (via e-mail) an image of a valid document (front and back). The image can also be easily acquired using a double photo taken with a mobile phone (2 shots, as long as they are legible). This request is necessary for 5 reasons:

  • first check the age of majority of the customer booking the work of art
  • verify the correctness and truthfulness of the nominal data entered in the work booking form (on a logistical level)
  • verify the correctness and truthfulness of the nominal data communicated to the Ministry of Cultural Heritage for the purposes of ministerial unblocking of the work of art in the event of export
  • contractually validate the customer’s consent when completing the booking form for the work (which triggers the subsequent technical shipping procedure of the latter)
  • contractually validate the data entered and the signature on the paper purchase contract which, provided to the buyer electronically, will be printed, filled out, signed and sent back electronically

The use of personal data is limited exclusively to the aforementioned verification and delivery operations of the work. The data set is naturally subject to all government regulations in force relating to the protection of privacy. For further details, please see the privacy policy below.
